About This Episode

Probate lawyers discover the legacy a loved one intended and how to implement that legacy most fairly. Scott Rahn meets clients during emotional and stressful times, but Scott’s zealous efficacy allows him to leave his clients in a better position regarding their loved one’s estates.

Scott did not have to become some loud-talking, arrogant jerk, as most litigators are portrayed, to get results for his clients. Scott Rahn explains that when you work with jerk lawyers, you will pay more money and get slower results when clients want to have their problems handled promptly for the least amount of money. You do not need a shark lawyer to receive results.

Scott Rahn’s Background

Scott Rahn attended undergrad in his home state of Wisconsin. Still, Scott has yet to make plans to leave sunny California. Although Scott wanted to become a mergers and acquisition lawyer, Scott discovered that he enjoyed probate litigation. Scott Rahn founded RMO Probate Litigation, a nationwide estate litigation firm.

Are Nice Lawyers Successful?

Scott Rahn is an excellent lawyer, but not a pit bull lawyer. Scott rejects the notion that you must be a shark, pitnbull, or adversarial, even though you are a litigator. Aggression does not equal success.

“I had the great fortune of being mentored to appreciate that you could be you; you didn’t have to be a difficult personality in a courtroom,” explains Scott Rahn, RMO Probate Litigation founder.

“With probate law, you get to meet people who are scared and mourning and leave them in a better place than where you found them,” explains Scott Rahn in Episode 77 of You Are A Lawyer.

What Can You Do With a Law Degree?

Probate law eventually touches every person's life, which is one of the challenges of probate law. Typical scenarios are when someone you know dies if you create a will or trust for yourself. When Scott Rahn became interested in probate litigation, Scott knew that he was ready to help people.

Lawyer Side Hustles

After practicing probate litigation for a few years while working for others, Scott Rahn decided to open his law firm, RMO Probate Litigation. RMO has grown and opened five offices nationwide.

Probate litigation is ensuring that the wishes of your client’s family are met. In law school or while studying for the bar exam, you will study wills, estates, or succession law. This involved someone dying with a will (or testate) or without a will (intestate). However, when family members challenge a will or the distribution of an estate, this is where probate litigation gets involved.

“Probate litigators are investigators,” explains Scott Rahn in Episode 77 of You Are A Lawyer. “We have to determine whether the will of our client’s family is being met.”

Lawyers Have Cool Interests

Scott Rahn is humanizing probate law. This practice of law is shown on television or in movies as the lawyer fighting to get a portion of the estate fees, but there is a lot more than that. Probate law is about helping people like you every day, which is the motto of RMO Probate Litigation.

Do not be discouraged from opening a trust. Trusts are not for Probate litigators are investigators who want to find out what happened with your loved one’s estate. Why are the documents correct, or could the documents be challenged? Were the documents constructed and executed where your loved one had legal capacity? Were estate documents signed when a loved one was incapacitated? Probate litigators work to meet their client’s wishes or help the other side understand why or why not an estate will be distributed in a particular manner.
